Please read these Terms & Conditions (“Terms”) carefully. By purchasing a QR code or using our website, you agree to these Terms.
- Definitions
- “Company”, “we”, “us”, “our” refers to Forever Memory SA (PTY) LTD T/A Forever Memory
- “User”, “you”, “your” refers to the person purchasing or administering a memorial page.
- “Memorial Page” refers to the digital tribute accessed via QR code.
- “Content” refers to photos, videos, text, or any material uploaded.
- Use of the Service
You may use the memorial service to:
- Create a memorial page
- Upload content related to the deceased
- Share the QR code with family and friends
You agree not to use the service for illegal or harmful purposes.
- Responsibility for Uploaded Content
You are fully responsible for all content you upload, including:
- Accuracy of information
- Obtaining consent from living individuals appearing in photos or videos
- Ensuring the content does not violate POPIA or copyright laws
We reserve the right to remove or block content that:
- Violates privacy rights
- Harms or defames others
- Contains violence, hate speech, or inappropriate material
- Violates these Terms
- Public vs Private Memorial Pages
You may choose whether your memorial page is:
- Public (visible to anyone with the link)
- Private (protected by a password or access settings)
We are not responsible for third-party sharing of publicly accessible memorial links.
- QR Code Products
Physical QR plaques will be delivered to the address you provide.
We are not responsible for delays caused by couriers or incorrect delivery information provided by you.
- Payment & Refund Policy
- Payments are processed securely through third-party providers.
- Refunds for digital memorial pages or used QR codes are not offered unless required by law.
- All products are inspected before delivery. Should any products be damaged or stolen we will consult with the courier service.
- Termination of a Memorial Page
We reserve the right to suspend or terminate a memorial page if:
- You violate these Terms
- You upload harmful, unlawful, or offensive content
- Required by law
You may delete your memorial page at any time.
- Intellectual Property
- You retain ownership of your uploaded content.
- By uploading content, you grant us a non-exclusive license to display it for the purpose of providing the memorial service.
- Our website design, logos, and branding remain our property.
- Limitation of Liability
We are not liable for:
- Loss of data due to user error or deletion
- Unauthorised access caused by weak passwords or misuse
- Damages arising from third-party sharing of memorial links
- Losses caused by downtime, outages, or internet issues
Our liability is limited to the amount you paid for the service.
- Amendments
We may update these Terms at any time.
Changes will be posted on our website with the updated date.
- Governing Law
These Terms are governed by the laws of the Republic of South Africa, including POPIA and applicable consumer protection laws.
